He spent over 10 years of his prime age inside bars for a crime he had not committed, he was wrongfully accused and convicted of a murder he never committed.
Erickson had no recollection of the night of the murder and was frightened that he could have been involved. Despite having no recollection of killing Heitholt, Erickson finally confessed and named Ferguson as a co-conspirator.
Ferguson was convicted of murdering Kent Heitholt. He was convicted in the fall of 2005 on the basis of Erickson’s testimony as well as that of a building employee.
However, both witnesses eventually recanted their testimony, saying that they were forced to lie by police and prosecution attorney Kevin Crane, who is now a circuit court judge.
The Western District of the Missouri Court of Appeals invalidated Ferguson’s 2005 conviction on November 5, 2013, and he was freed on November 12, 2013.
